Our firm handles criminal matters at all levels of complexity.  We understand that whatever the charge, the long-term consequences of a criminal record can be devastating to the client, and we seek the best outcome under all the circumstances.

We defend against serious felony charges which require intensive and thorough fact gathering, analysis and action before trial to assure the protection of the client’s rights.  We use equal care in show-cause hearings which may prevent a criminal complaint from issuing. Our aggressive trial preparation means that we gather facts through professional investigators, employ necessary experts, file appropriate motions,  and obtain all possible exculpatory evidence in the possession of the government.  Often, this exposes vulnerabilities in the government’s case, and some or all of the charges may be dropped.  At the same time this work is done, careful ongoing analysis guides the client to the best outcome, given the circumstances.  The client always controls the decision about whether to try the case or enter a plea.  We are intimately familiar with the practice in the district court and the ways in which minor criminal matters can be disposed of without creating a criminal record.  In some cases, a matter can be disposed of at the show cause stage, without a complaint issuing. 

We have special expertise in handling cases with mental health issues, with accusations of sexual offenses and sex offense registry board actions, in felonies of all types, and charges of operating under the influence (OUI).  Ms. Flournoy served for 10 years as an Assistant District Attorney in Berkshire County, trying serious felonies and heading the appellate unit.  She has done defense work for another 16 years. A speedy consultation with a lawyer is necessary after arrest, after a call from the police for questioning, in the face of a suspicion that a crime may have been committed, or that you may be suspected of one.  Even an innocent person needs the help of an attorney to establish their innocence and to ensure that their rights are protected.  It is never a good idea to discuss conduct which may constitute a criminal offense with the police, with persons who may be witnesses, or may be accused along with you, or even with family members.
